Two Supreme Court judges, referenced a "harsh" remark made by Chief Justice D.Y. Chandrachud about Justice V.R. Krishna Iyer's judicial approach in a “proposed judgment.”
Justice Iyer was a renowned former judge, known for his humanism and criminal justice reforms, notably coining the principle "bail is the rule, jail is the exception."
The Chief Justice's final majority judgment did not include the "disservice" remark but did reference the “Krishna Iyer Doctrine,” which focuses on economic and social policy.
He emphasized that the court should not interfere with economic policy decisions.
Justice Nagarathna disagreed with the Chief Justice’s remarks, stressing that past judicial wisdom should not be devalued due to changes in the country’s socio-economic policies since the 1991 economic reforms.
She emphasized that the Supreme Court’s institution is greater than any individual judge and cautioned against criticizing past judges.
Justice Dhulia found the Chief Justice’s remarks about Justice Iyer "harsh" and unnecessary.
