The Supreme Court questioned whether demolishing the homes of accused individuals or their relatives is a form of public retribution, which is not allowed by law.
The Court emphasized that the law does not permit the destruction of family homes, even for those who have been convicted of crimes.
The Uttar Pradesh government argues that demolitions are carried out according to municipal laws and procedures, and denies that these actions are retributive
The government also argues that in some cases, demolitions were already planned for illegal structures before the individuals became accused of crimes, and thus, should not be seen as retaliatory.
The court listed the case for laying down guidelines.
It asked petitioners to provide suggestions.
