What is Rule 3(1)(b) of the IT Rules, 2021
Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, outlines specific obligations for significant social media intermediaries in India regarding the removal of certain types of content.
These are social media platforms with a user base exceeding a certain threshold, as defined by the Indian government.
The rule requires intermediaries to take down content that is prima facie (at first glance) in the nature of:
Material exposing private areas: This includes content that depicts individuals in full or partial nudity or exposes their private parts.
Sexual content: This encompasses content that shows or depicts individuals engaged in sexual acts or conduct.
Impersonation: This includes content that impersonates an individual, including artificially morphed images.
Timeframe for action: Upon receiving a complaint from an individual or their representative regarding such content, the intermediary must remove or disable access to the content within 24 hours.
