The IT Act, 2000 has been contentious legislation since its enactment.
The Act gave a new direction to how cyber-crimes are dealt with in India.
One particular section that has been a subject of deliberation off late is Section 67.
The section penalizes publication and transmission of obscene material, containing sexually explicit acts, and depicting children in sexually explicit acts in electronic form.
The punishment can be up to 7 years along with fine that can be up to 10 lakh.
The grey area in this provision leaves scope for misuse and misinterpretation.
Why in News
Liking a post on Facebook or X (formerly Twitter) cannot be punishable under Section 67 of the Information Technology Act because it does not amount to “publishing or transmitting” the post, the Allahabad High Court has now held in a recent judgment.
