PepsiCo supplies the FC5 seed variety to farmers who sell their produce to the company.
The variety has lower moisture content suitable for making potato chips.
PepsiCo claims it exclusively developed and registered the FC5 variety in 2016.
In 2019, PepsiCo sued Indian farmers for cultivating the FC5 variety, alleging patent infringement.
The Protection of Plant Varieties and Farmers' Rights Authority revoked PepsiCo's patent for the FC5 potato variety, stating that India's rules don't allow patents on seed varieties.
But court rejected PepsiCo Inc.'s appeal against the revocation of a patent for a potato variety used in Lay's potato chips.
The revocation came after a farmers' rights activist argued that PepsiCo couldn't claim a patent over a seed variety.
PepsiCo filed an appeal in the Delhi High Court against the revocation of the patent.
However, the company later withdrew the lawsuits, and the Delhi High Court didn't find any public interest violation by PepsiCo.
It is turned down by Delhi High Court
